Ralph T. Smith, Jr. (“Defendant”), was charged with the class A felony of robbery in the first degree with what appeared to be a deadly weapon, pursuant to section 569.020, and the class B felony of robbery in the second degree, pursuant to section 569.030.1 A jury found Defendant guilty of both offenses, and the trial court sentenced Defendant as a prior and persistent offender to thirty years in prison on each robbery, with the sentences to run concurrently.
