PRICE, Chief Justice.

This is an appeal from a judgment of one of the District Courts exercising jurisdiction in El Paso County. Lester P. Jackson and Pauline Nash Jackson, as plaintiffs, sued Tom McCrary, as defendant, to recover damages for personal injuries alleged to have been inflicted upon plaintiffs and damage to their property by the negligence of defendant’s agent, in leaving in the nighttime an . unlighted truck parked upon the highway with which the automobile driven by plaintiff Lester Jackson collided, and thus inflicting injuries for which recovery was sought.
