Appeal by the defendant from a judgment of the Supreme Court, Kings County (Goldstein, J.), *331rendered October 18, 1983, convicting him of criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance in the third degree, upon a jury verdict, and imposing sentence.

Judgment reversed, on the law, indictment dismissed, and matter remitted to the Supreme Court, Kings County, for entry of an order in its discretion pursuant to CPL 160.50.
