On August 16, 1919, appellant and appellee entered into a written contract for the sale of a tract of land in McLennan county the substance of which was that appellee was to pay appellant therefor the sum of $7,000 in cash, and also the further sum of $10,000 in cash, payment to be made January 1, 1920, at which time appellant was to execute a deed to appellee and deliver him possession of the land.
