This case came before the Supreme Court on December 8, 1998, pursuant to an order directing the parties to appear and show cause why the issues raised in this appeal should not be summarily decided. After hearing the parties’ oral arguments and examining their memoranda, we perceive that cause has not been shown and shall therefore proceed to decide the merits of this appeal at this time. The plaintiff, Carmino C. DePasq-uale (DePasquale), appeals from the trial justice’s grant of summary judgment on behalf of the defendants, Venus Pizza, Inc. et al. (Venus).
