In an action in garnishment in the Municipal Court hy Mennella, plaintiff, against Bottigliero as garnishee, tried hy the court without a jury, plaintiff had judgment for $862 and the garnishee sued out this writ of error. There is in the record what is certified by the trial judge to be a “full, true and correct stenographic report of all the evidence introduced or offered and of all the proceedings in the cause.” There is no evidence in the record of a judgment against the nominal plaintiff or of the issue of an execution and the return thereof by the proper officer, “no property found.” As…
