The authority for this litigation is the Nebraska Workmen’s Compensation Act. Appellant made claim thereunder to the Nebraska Workmen’s Compensation Court for alleged disability resulting from a claimed accident and injury arising out of and in the course of employment of appellant by appellee. One of the judges of the compensation court heard the claim of appellant and granted him an award. The parties each waived rehearing in the compensation court and an appeal was taken by appellee to the district court for Dawson County.
