—In an action to recover damages for personal injuries, the defendant appeals, as limited by its brief, from so much of an order of the Supreme Court, Nas*201sau County (Levitt, J.), dated December 8, 1998, as denied its motion for summary judgment dismissing the complaint and granted that branch of the plaintiffs cross motion which was to amend the caption pursuant to CPLR 305 (c).

Ordered that the order is reversed insofar as appealed from, with costs, the motion is granted, that branch of the cross motion which was to amend the caption is denied, and the complaint is dismissed.
