Reversing.
Will McKey, a negro, was indicted by tbe grand jury of Ohio County at its October term, 1910, charged with *451the crime of unlawfully taking and detaining a woman against her will with intent to have carnal knowledge of her. To this indictment he entered a plea of not guilty. A trial before a jury resulted in his conviction, and he was given an indeterminate sentence of from two to seven years imprisonment in the penitentiary. He appeals.
