The indictment charged that the appellant “did buy, receive, conceal, or aid in concealing a lot of pine lumber, to-wit, 102 pieces of 2 x 8 x 16 s4s # 3 pine lumber and 237 pieces of 1x8 RL (random lengths) s4s # 3 pine lumber, of the value of, to-wit, $364.00, the personal property of Scotch Lumber Company, a corporation, knowing that the same was stolen, and not having the intent to restore same to the owner, against the peace and dignity of the State of Alabama.” The appellant entered a plea of not guilty. The trial resulted in a verdict as follows, “We, the jury find defendant guilty.”…
