This is an original proceeding in mandamus. The case is before us on the defendant’s demurrer to the alternative writ. The question arises out of the denial by the defendant, the Honorable A. T. Goodwin, circuit judge, of a motion to quash the service of summons *515in a case pending in Curry County in which the plaintiff here, the State of Oregon by and through its State Highway Commission, is the defendant.
