FINDINGS OF FACT AND CONCLUSIONS OF LAW

This case involves an international letter of credit between Cappaert Enterprises (“Cappaert”), as the customer; Citizens and Southern International Bank of New Orleans (“C & S Bank”), as the issuing bank; and the Bank of Kuwait and the Middle ■East (“BKME”) as the beneficiary. Based upon Cappaert’s unrebutted representation that fraud occurred in the transaction this Court entered a temporary restraining order and subsequently granted a preliminary injunction predicated upon Cappaert’s demonstration that there existed…
