The motion of defendant United States Shoe Corporation (“U.S. Shoe”) to dismiss or, in the alternative, for summary judgment, came on for hearing before this court on January 7, 1991. John R. Myrdal, Esq. appeared on behalf of defendant U.S. Shoe. James E. Duffy, Esq. appeared for plaintiffs The Daiei, Inc. (“Daiei”) and U.S. Shoes Japan Limited (“U.S. SJL”).
