Appeal from Clay District Court. — Hon. Lot Thomas, Judge. Ti-ie defendant was indicted, tried, and convicted of the crime of forgery; and judgment that he be committed to the penitentiary for a term of three months, and that he pay costs, was entered against him. From this judgment, he appeals.

The following is a sufficient statement of the facts for an understanding of the questions presented: The forgery charged is the altering of the sixth, seventh, twelfth and fifteenth special findings returned by the jury in a case wherein this defendant was plaintiff, and the American Pill & Medicine Company of Spencer, Iowa, was defendant. In that action this defendant sought to recover for services under an alleged contract of employment for a specified time, and damages for discharging him without cause before the expiration of the time.
