MEMORANDUM OPINION
BULLOCK, District Judge.
After consideration of the issues in this case on four separate occasions by the United States Court of Appeals for the Fourth Circuit, and once by the United States Supreme Court (another petition for certiorari was denied), the case is again before the district court pursuant to remand from the court of appeals for the taking of evidence and the development of a full record.
