Appeal from so much of an order of the Supreme Court at Special Term, entered January 3, 1975 in Tompkins County, which granted plaintiffs motion for an injunction and denied defendant’s cross motion to dismiss the complaint. The plaintiff brought an action to recover the balance alleged to be due on a contract for the sale by plaintiff to defendant of plaintiffs *974trucking business.
