Before the Court are cross motions for partial summary judgment in the above-captioned adversary proceeding filed by Sprint Nextel (“Sprint”) in the Chapter 11 case of TerreStar Networks, Inc. (“Ter- reStar”) and the jointly administered debtors, Case No. 10-15446 (collectively, the “Debtors”). Debtor TerreStar is a mobile satellite services provider whose business requires a Federal Communications Commission (“FCC”) license to use 20 MHz of a 2 GHz S-Band spectrum (the “S-Band License”).
