I respectfully dissent. I do not understand how to apply the harm analysis the Court of Criminal Appeals tells us to use in Rose v. State, 752 S.W.2d 529 (Tex.Crim.App.1987) (op. on reh’g).
Since issuing Rose, the Court of Criminal Appeals has remanded 390 cases to the courts of appeals to decide whether the parole instruction1 caused harm. The remand of these cases is one of the most important issues in our criminal justice system today.
