AMENDED MEMORANDUM ENTRY
NOLAND, District Judge.
I. Background
This cause is before the Court on appeal of Bankruptcy Judge Utschig’s decision that (1) the payments from a structured settlement agreement which the debtor has been receiving are not part of the bankruptcy estate, and (2) even if the payments are included in the estate, that they are exempt under Indiana Code 27-2-5-1 and 11 U.S.C. § 522(b)(2). On July 9, 1991, the Court reversed the Bankruptcy Court’s decision, and remanded this cause for further proceedings. The trustee has since filed a Motion for Clarification of Judgment and…
