The appellant, Pearl Adams, by her father and next friend, W. V. Adams, sued the appellee, St. Louis Southwestern Railway Company of Texas, to recover damages for personal injuries' alleged to have been received by her through the negligence of the appellee’s servants.

It is alleged that on the night of June 10, 1908, .Pearl Adams, a minor of about 17 years of age, was a passenger on one of appellee’s trains, traveling alone, en route from Memphis, Tenn., to Dallas, Tex.; that about the time she reached Texarkana she was taken suddenly ill with fever; that between Texarkana and Greenville,…
