Appeal from an order of the County Court of Rensselaer County (McGrath, J.), entered August 13, 2003, which classified defendant as a risk level III sex offender pursuant to the Sex Offender Registration Act.

Defendant was convicted in 1996, upon his guilty plea, of the crime of attempted sodomy in the first degree (234 AD2d 829 [1996], lv denied 89 NY2d 1037 [1997]). In 2003, the Board of Examiners of Sex Offenders prepared a risk assessment instrument pursuant to the Sex Offender Registration Act (see Correction Law art 6-C), presumptively classifying defendant as a level II sex offender,…
