ELLETT, Justice:

The plaintiff (hereinafter called the petitioner) and his wife were jointly charged in the Sixth Judicial District Court of Utah with the crime of robbery, a felony. Petitioner was sentenced and committed to the State Prison, which is located in the Third Judicial District of Utah. After being confined for two months in the State Prison, he sought and obtained his release from prison on a writ of habeas corpus filed in the court of the Third Judicial District.
