MEMORANDUM DECISION
CHRISTENSEN, District Judge.
Jerry McGuffey, a state prisoner, claims in his petition for a writ of habeas corpus here that he has been deprived in state proceedings of assistance of counsel, was forced to confess guilt and was deprived of his liberty without due process in violation of his rights under the federal Constitution. Exhaustion of state remedies is shown. Upon his petition this court issued a writ of habeas corpus to accord an evidentiary hearing with the petitioner present, and such hearing was set for the 10th of March, 1967.
