D. 1878, with force and arms, one certain bay mare belonging to and the property of David J. On the trial of this case in the court below the defendant offered the following pleas:—
“To the said information the defendant here in court pleads and says that he is not guilty as charged in said information. And for a further plea in this behalf the defendant says that he ought not to be further prosecuted in this case on said information, because he says that the said supposed offence in said information mentioned was *436committed, if ever, more than three years before the time when the defendant was required to plead or make answer' to the said information.
