The defendant in error brought an action against tbe plaintiff before a justice of the peace to recover the sum of $31.75 and interest. The plaintiff in error thereupon filed a claim of set-off for the sum of $200 and sought an affirmative judgment. On the 16th day of February, 1886, a trial was had, the docket entry being as follows:

“Whereupon the following persons were sworn and gave their evidence for plaintiff: John M. Carter, Henry Carter, William Carter, and B. C. Yoeman; and on the part of defendant, Robert Wilkinson and A. E. Cochran. After hearing the evidence and…
