Appeal by the defendant from a judgment of the Supreme Court, Kings County (Fuchs, J.), rendered November 15, 1984, convicting him of robbery in the first degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial, after a hearing, of that branch of the defendant’s omnibus motion which was to *498suppress identification testimony. By decision and order dated January 17, 1989, this court remitted the case to the Supreme Court, Kings County, to hear and report on whether the police obtained a valid waiver of the defendant’s right to counsel at a lineup, and for a…
