This case was originally brought in the 56th Judicial District Court of Galveston County, Texas, on November 9, 1998. The case was removed to this Court by Defendants on February 12, 1999. Defendants alleged diversity jurisdiction under 28 U.S.C. § 1382. Plaintiffs, arguing that the removal was procedurally defective, now seek remand of this case pursuant to 28 U.S.C. §§ 1446(b), 1447(e).
