Plaintiff-appellant Lekunutu Matima (“Matima”) alleged that his former employer, Ayerst Laboratories, Inc. (“Ay-*71erst”), discriminated against him because of his race and national origin and discharged him in retaliation for complaining about that discrimination, in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2, as amended by the Civil Rights Act of 1991 (“Title VII”); 42 U.S.C. § 1981; and New York State Executive Law § 296.
