Justin B. (Appellant), a minor under seventeen years of age, challenges the active electronic monitoring (electronic monitoring) requirements of section 23-3-540 of the South Carolina Code. Section 23-3-540 requires that individuals convicted of certain sex-related offenses, including criminal sexual conduct with a minor in the first degree (CSC-First), submit to electronic monitoring for the duration of the time the individual is required to remain on the sex offender registry.
