This is an appeal from an order of the ■District Court of El Paso County, Texas, Forty-First Judicial District, overruling a motion for a new trial made by Elizabeth Seymour and J. J. Watts and Wilford Seymour, as executors under the will of David S. Fenchler, deceased, in a cause numbered 45,260 on the docket of said court, and entitled The City of El Paso, Plaintiff, State of Texas, Intervener, v. David S. Fenchler, et al.
