This is an action for the possession of land. The Court intimated an opinion against the plaintiffs. They thereupon submitted to a nonsuit, and appealed.
The State granted tbe land to Lewis Jones, 25 October, 1852. This grant was not registered until 1888, at a time when there was no law permitting the registration of it. On 17 December, 1880, a grant for the same land was issued to Alexander Oox, and legally registered 28 January, 1881. The plaintiffs assert title to the land under the grant to Cox, and the defendants under the Jones-Alexander grant; so that the question is, Which of these…
