MEMORANDUM OPINION

SENTER, Chief Judge.

This action arises out of plaintiffs complaint for judicial review of his three-year disqualification from participation in the food stamp program imposed by the United States Department of Agriculture, Food and Nutrition Service. Both parties have filed motions for summary judgment, each arguing that there is no genuine issue of material fact.
