Hood v. Hall
Appellate Court of Illinois
1Opinion of the CourtJustice Welch
This appeal is from an order of the circuit court of Jackson County, entered October 6, 1999, denying the motion of Richard Hall (appellant), filed pursuant to section 2—1401 of the Civil Practice Law (735 ILCS 5/2—1401 (West 1998)), to vacate a tax deed issued to Herman Hood, doing business as G&H Investments (appellee). Appellant argues that the issuance of the tax deed was stayed by virtue of appellant’s bankruptcy proceedings and that the tax deed is void ab initia because it was issued in violation of the automatic stay of the Bankruptcy Code (11 U.S.C. § 362 (1994)).
