John R. Arkley, while in the employ of the plaintiff in error as a coal miner, was killed at his work in the mine by the fall of a rock on May 24, ig"i2. The plaintiff in error having elected not to provide and pay compensation as provided in the Workmen’s Compensation act, the administratrix of Arkley’s estate brought an action on the case for damages caused by his death, in the circuit court of Vermilion county and recovered a judgment for $5000, which the Appellate Court for the Third District affirmed.
