MEMORANDUM OPINION AND ORDER

Pending is the motion to dismiss filed by the two Defendants who were added to this action by way of the Plaintiffs’ amended complaint. This Court has previously addressed motions to dismiss filed by other named defendants. Clark v. Milam (Clark II) 1 830 F.Supp. 316 (S.D.W.Va.1993). This action was brought by the Plaintiff, Hanley C. Clark, Commissioner of Insurance for the State of West Virginia, the appointed Receiver of the George Washington Life Insurance Company (“GW LIFE”).
