Alameda Gateway (“Gateway”) appeals the district court’s grant of summary judgment in favor of the Army Corps of Engineers (“Corps”) and its denial of Gateway’s cross-motion for summary judgment. The Corps removed portions of Gateway’s piers pursuant to its authority under section 10 of the Rivers and Harbors Appropriation Act of 1899 (“RHA”). See 33 U.S.C. § 403.
