K.E.S. v. United States
Court of Appeals for the Eighth Circuit
1Opinion of the Court
LOKEN, Circuit Judge.
The plaintiff in this case, a young woman now in her mid-twenties, commenced this damage action under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b), 2671-80 (FTCA), alleging injuries stemming from an Army recruiter’s repeated acts of sexual abuse and misconduct. The District Court 1 dismissed with prejudice, concluding that the action is barred by the two-year statute of limitations governing tort claims against the government. See 28 U.S.C. § 2401(b). Plaintiff appeals. We affirm.
