The City of Shelbina (hereinafter, “the City”) appeals from the trial court’s grant of summary judgment in favor of Shelby County, Missouri, et al. (hereinafter, “the County”) on its petition seeking a writ of mandamus and declaratory judgment. The City raises two points on appeal. First, the City argues the trial court erred in entering summary judgment in the County’s favor in that Ordinances No. 1094 and No. 1095 were enacted validly and the County failed to carry its burden of proving the City acted in excess of its powers by enacting the ordinances.…
