Appellant was tried in the Criminal District Court, of Dallas County, on the charge of murder, was convicted of murder of the first degree, and his punishment assessed at death. From the judgment of the lower court he prosecutes this appeal. There is but one question presented in the record in this case which requires consideration by us.
