MEMORANDUM DECISION GRANTING MOTION TO DISMISS THE INVOLUNTARY PETITION

The alleged debtor, Compañía de Ali-mentos Fargo, S.A. (“Fargo”), is an Argentine company. Since 2002, it has been pursuing a concurso preventivo (the “Con-curso ”), a reorganization proceeding, in Argentina. Argo Capital Investors Fund SPC, Rainbow Global High Yield Fund, Rainmac Fund and the Star Fund (collectively, the “Petitioners”), off-shore investors, hold approximately 65% of Fargo’s public debt.
