BACKGROUND

In the early morning of March 20, 1999, Kip P. Hookstra, walking with two friends near the intersection of 13th and O Streets in Lincoln, Nebraska, came upon Officer Mitchell Evans of the Lincoln Police Department, who was administering field sobriety tests on an individual. Hookstra and his two friends crossed 13th Street, walking behind Officer Evans’ police car, which was parked along 13th Street.
