At issue in this case is the constitutionality of a Lincoln ordinance which makes it unlawful to “intentionally or knowingly refuse to comply with an order of a police officer made in the performance of official duties at the scene of an arrest, accident, or investigation.” Lincoln Mun. Code § 9.08.050 (1990). In affirming the conviction of Kip P. Hookstra under this ordinance, the Nebraska Court of Appeals held that the ordinance was not facially unconstitutional on the ground of overbreadth and that Hookstra lacked standing to challenge the ordinance on the ground of vagueness.
