The defendant was convicted of reckless driving of an automobile. The trial court denied a motion for a new trial, and the defendant appeals.

It is charged the court erred in permitting one W. K. Spaulding, a duly licensed and practicing attorney in this state, to assist the prosecution without having been appointed by the county commissioners, or by the court, and not being an assistant attorney general nor being under oath of office as assistant state’s attorney.
