The appellant, Marvin Felton Whitlow, Jr., was convicted of trafficking in cannabis and sentenced to five years' imprisonment.

An Auburn, Alabama, police officer arrested one Donald Pouncey for the sale of marijuana to undercover officers. Pouncey agreed to cooperate with the police in arresting other individuals selling marijuana.
