Affirming.

The appellant, Alex. Alsop, was indicted by the grand jury of Scott County for the crime of murder, committed by his shooting with a shotgun and killing Charles Parish. The trial resulted in a verdict finding him guilty of murder and fixing his punishment at confinement in the penitentiary for life. Prom the judgment entered upon this verdict he has appealed.

Briefly stated, the facts respecting the homicide were as follows: On the day of the shooting the deceased went to the home of Claude Rogers, in Scott County, and found, in a cabin in Rogers’…
