The appellee’s complaint states that on July 24,1897, John Cross died testate, in Jackson county. “That his last will and testament was duly probated and recorded in the office of the clerk of the Jackson Circuit Court- of said county on the 26th day of August, 1897. See will record three, pp. 58, 59.
