The questions here involved arise in proceed^ ings instituted by the board of park commissioners of the city of St. Paul, to acquire lands for the purposes of-a park; and the lands of the petitioner and others have been assessed for benefits arising from the improvement, under the provisions of the act creating a board of park commissioners for the city, and the' amendatory acts of 1889.
