This suit was filed in the District Court of Dallas County, Texas, by Deck Martin and Charlie Rogers against Texas & Pacific Railway Company to recover title and possession of certain real property in the City of Dallas, Dallas County, Texas, fully described in the deed which is later fully set out in this opinion. Trial in the District Court, where the case was submitted to a jury on special issues, resulted in a verdict on which the trial court entered a judgment for the railway company.
