—Appeal and cross appeal from an order of Supreme Court, Monroe County (Stander, J.), entered September 27, 2001, which granted that part of plaintiffs motion seeking summary judgment on the issue of liability and denied that part of plaintiff’s motion seeking judgment in the amount of the deficiency.
