Plaintiff in error, hereinafter called defendant, was convicted in the county court of Harmon county of the unlawful possession of intoxicating liquor, and his punishment fixed by the jury at a fine of $250 and imprisonment in the county jail for 90 days.

The evidence of the state was that they had a warrant for the arrest of defendant, charging the sale of intoxicating liquor to a minor, which is a felony; that defendant was rooming at the Hart Rooming House; that the officers went to the door of his room and opened the door and went in; that as they entered defendant was breaking pint…
